Reference Answer

### Definition of "Unseaworthy Vessels" under the M.S. Act, 1958
Under the Indian Merchant Shipping Act, 1958, an "Unseaworthy vessel" is defined in Section 334. A ship is considered unseaworthy when, due to its state or condition, it is not fit to encounter the ordinary perils of the sea without posing a serious danger to human life. This unfitness can arise from several deficiencies:
1. **Defective Condition of the Hull, Equipment, or Machinery:** This includes wastage in plating, structural defects, inoperative critical machinery (e.g., main engine, steering gear, generators), or malfunctioning safety and navigational equipment.
2. **Overloading or Improper Loading:** A vessel loaded beyond its load line marks, or with cargo improperly stowed or secured, is unseaworthy as its stability, structural integrity, and maneuverability are compromised.
